Agreement for Photography
TIME LINE: I will select a few of the best images from your session with in one week and post them on my website for you to pick your favorites. Once you’ve notified me of your choices, I’ll send you a link for your high resolution digital images within 72 hours or arrange to have a disk delivered to you.
COPYRIGHT: All images and copyrights are the sole property of Rebecca Clarke Photographer. These images are protected by Canadian Copyright Law (all rights reserved). Included with the purchase of high resolution digital images is a limited license to you use the images on the web, in print, or for other promotional purposes. Claiming copyright is prohibited.
PAYMENT SCHEDULE: Unless otherwise agreed to by Rebecca and you, the client, the following terms apply to payment: For individual business portraits the session fee is due upon booking. It is your retainer, holds your session date and is non-refundable. For multiple sessions on the same day, or workplace interiors and exteriors a retainer of 25% is due upon booking with the balance due within 15 days. For event coverage payments are due in full upon my arrival to the event (or in advance). Payments can be made via credit card through PayPal (no PayPal account required), via cheque, or via cash. All payments and are subject to HST.
LIMIT OF LIABILITY: If I am injured or become too ill to photograph the session, I will rebook it for an alternate time (subject to availability) at no additional cost. If you find the alternate time unsatisfactory, you may choose to cancel this agreement and receive a full refund of any fees paid. I take the utmost care with respect to exposure, transportation, and processing of the photographs. In the unlikely event that photographs have been lost or damaged, or are undeliverable for any reason, my liability is limited to the return of all payments made. The limit of liability for a partial loss of originals shall be a prorated amount based on the percentage of lost images from the total number of originals taken.
MODEL RELEASE: I may use any of the images taken (in whole or in part) for self promotion, display, or sale. This includes but is not limited to: publication, advertisements, internet, print competitions, and educational seminars.
COOPERATION: I am not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to me. I reserve the right to cease service if any member of the portrait session fails to cooperate.
If you are sick, we can reschedule the session at no extra cost (subject to availability). Please inform us as soon as possible should this be the case.
AMATEUR PHOTOGRAPHERS: Amateur photographers may not take pictures during Business Portrait sessions or Workplace Interiors and Exterior sessions. I am the sole professional photographer aloud to photograph during events. Amateur photographers may take pictures during the event if they do not interfere with me, the contracted photographer.
ADDITIONAL EVENT COVERAGE: Subject to availability – Additional coverage over and above the time agreed upon for the event can be purchased by the hour or any part thereof for $125. For example: if you only require an additional half hour the rate will be $125 x 0.5 for a total additional charge of $62.50.
TRAVEL: All destinations outside of a 50 km radius of downtown Halifax will incur a $0.65 per kilometer fee. Fees for locations over 500 kilometers will be provided by quotation.
